Guys In a bit of a conundrum. My employer and vendor are not willing to give out letters for my employment because I am a consultant. Has anyone filed for H1 without including those? Did you receive a RFE? Was wondering if, it is even possible to send some documents which my teammates will attest to me working here, copy of ID etc. Any ideas or suggestions?

thecakeisalie, I have seen guys easily getting H1b even without client letters but I mostly you will get RFE if you don't have those letters. So, for end client, just send email conversations with your onsite supervisor, or the org charts and the company batch as a proof that you are working in the end clients work site. For vendor, you can easily threaten them. Just tell them that you need a letter clearly stating that you are a contractor to the vendor and vendor does not pay your salary and the project is good for at least 3 years. Tell them if you do not get the letter you will have to leave the project as you cannot get h1b. These vendors are getting free money from you doing nothing. So they will not deny any of your request. NE_Pats

Glad that somebody asked this question. I was also going to ask the same. Thanks Superbowl champion bro for your response :) Also, let me ask you this bro, since I'm pretty sure you know the answer to. If your H1 gets approved (way too far from me at this point), do you have to go back to Nepal? Or can you just stay here working and later apply for Green Card when you are eligible to? Jai Nepal!!

NoSambidhan bro, I am assuming that you are working here in F1-OPT/CPT. If your H1b petition is approved the you will either get I-797A (I-90 attached to it) or I-797C. If you get I-797A, it means that you got h1b and change of status as well. If you get this form then you are all set. You don't need to go back to Nepal for stamping. You can stay here and apply for GC. For this case stamping is needed only if you want to go out of country for vacation. If you get I-797C, it means that you got H1b but your change of status is denied. In this case, you have 15 days (or 30 I forgot ) to leave US and go to Visa Consular in your home country. US consular will then issue you a new H1b visa. tl:dr, I-797A -> Good no need to leave country I-797C -> Bad. Leave country immediately Regards, NE_Pats
