Hi,
I applied for H1b last April from real american company and USCIS requested evidence Which Says " Indicate how many other individuals currently employ in similar position, as well as how many have been employed in the past. Of these, how many holding at least a Bachelors degree and in which field of study. Submit documentary evidence such as W-2, Copies of Degrees, Transcript etc, to support your evidence." .....My employer did gave me 2-3 Degrees to support my documents but I have 13 people working with me....My question is do I need all the people's degrees to support ....... Lawyer prefer all of them but I did ask my employer they were not giving me any more degrees due to privacy.....Can you please suggest what should I do.
Thanks In Advance KJ

I don't have any experience in this matter but it sounds like just by looking at your job title the USCIS isn't convinced that the position fulfills the requirement that 'the job offered to you must be a specialty occupation which normally requires a baccalaureate degree, in the industry, to discharge duties'. So, it's a matter of convincing them that the job you are going to be doing is something that is being done/has been done by people holding at least a bachelors degree in your field of studies. Now, it's hard to guess exactly how muck convincing(proof) the officer looking at your case is going to require. Obviously, ideally you would want to submit the educational qualification of all 13 people but if that's not possible I think you will be okay if you submit the qualifications of as many people as you can. Has that company sponsored any H-1 visas in the past? If it has, I think including that information will make your case really strong.
Just out of curiosity, what is your job title? That could help other people give you better suggestions. Good luck!

Nowadays USCIS is enforcing strict rules for H1B since lot of people are unemployed here. REF are common even for simple genuine application and simple transfer. So please try to collect as much evidence as you can and reply to them that what you can do.Ask your lawyer and employer to support your application in the way they can.Hope that helps.I see lot of very good and high profile cases going for REF I think they are changing strategy to enforce strict rules.

This is the first time i came to know about RFE which was asking info of others. Usually RFE should be regarding you and because of privacy no employer will give others employee info. If my employer shares my info such as my degree, transcript, W2 etc with other...I will immediately leave the company. there should be some misunderstanding with RFE.
