Hi One of my friend has been selected in dv visa lottery for 2007. He and his wife has been living in US and both are in good status. What is the process of filing for green card? Is lawyer required to handle this case? Thanks in advance. dun

dun, No need to hire a lwawyer, If he or she is legal here in US, when you get first letter they will ask you where u want to go for an interview, You can choose Nepal or canada whichever you want to just follow the procedure i.e make the police report for both of them from place where they have stayed after 18 the birth day, Bank statement depends on sponsor letter. Some says no need ot sponsor letter but i don't trust none of them, I will find a sponsor, since they are staying here and I don't see anything hard for them to get Sponsor letter .Its very simple and to the point. But if they are illegal then my suggestion is to hire a lawyer. Hope this helps

ya, I have the same issue. I'm here in US with F-1 visa and won DV2007. I requested for Consular processing but now I am not sure if I should do adjustment of status from here in US or do consular processing from nepal. Any suggestion?

hehe...I knew you love them all. :P Why should they be 'despised', especially by person like you, for being lucky? :)

go for consular processing if you worked illegal while in F1 else AOS is good.

Offline, What do you mean? What's the difference? is AOS riskier than Consular processing? Nails: If you don't have anything specific comment on the thread, please don't just type JPT. I don't really appreciate when you divert the thread's direction (I have seen you doing the same in other threads too).

Dunno, They don't need to go anywhere to process their DV. They can have the "adjustment of Status" here through Immigration/Homeland security. As long as they are in good status, I think it would be much easier to have their status adjusted here. What is their number (serial number for DV lottery)? The numbers are already out for December and is upto 3500 for South Asia.

guys i am also a dv winner for 2007. I am adjusting the status here. Those who want to have status adjusted they don't get second letter from KCC.Rather they get a letter which says go ahead and adjust your status whenever your number is current and don't contact Kcc anymore. My number will be current next month so I have all the document s ready by now and I will file next month.Just you have to file form I 485 and Form G 325 A with other general documents as stated in the uscis site. If anybody needs help certainly I will help. I recommend not to hire lawer as long as you are legal resident just you have fiil the forms and send them to the correct address.later in case problem shows up you can hire

Jayamatadi, Thanks for offering help. I ll email you shortly. As for your inquiry, If you are doing AOS from here and your spouse is doing CP from nepal. gotta run... I will rmail you later. Meanwhile read the first NLagain. It says right on there what to do if you are doing AOS from here and your spouse is doing CP from your homecountry.

Try not to go to Nepal. Since you are in good status do it here. Much easier. Back home you never know. I was in nepal and trying to help some DV winners those who added there family after the fact. There visa fee was taken ( 55000) from each family member and denied on the ground of Section 212a. Cause they did not show there family member in the orginial application. The fact of the matter is embassy was issuing visa to added family till 2005, that is doublestandard. The priminister spoke to the ambassodr no result. I offered them to file a class action law suit, but they were to tired after one years energy and financial loss. Few winners commited sucide, some of them are in financial trouble, some lost their job. Another thing is the receipt of the visa payment given to Dv winners are no longer a prrof of pay because the ink dissapeared so no proof. I have informed the State dept. and Homeland security and waiting for the response. The home land security actually approved the added family in writing to each of them. About 100 family is suffering. They are also rejecting people with job experience instead of plus 2. Also Nepali staff are working against the Dv winners for some reason.
