santoshgiri, interesting Fantasy Defense stuff. I guess this only applies for someone who is a US citizen & has money to hire a decent criminal lawyer to defend him.

In this case, a public defender will be assigned to Basnet ji. They don't give a shit. Basnet ji is not a US Citizen and also cannot hire expensive lawyer. As you might know thesedays how much rights aliens have?? Soon we will see Basnetji like in this website.

Santosh Giri - Thanks for your comments. Question for you: can you shed any light on the cases against those caught on TV? What has happened to those people? Do we know how many were convicted and what charges they were convicted on? And if they got off, what grounds did they win on?

Santosh - I meant those on NBC Nightline ("to catch a predator" episodes). Any idea what the hard data on those cases is? How many convictions versus acquittals?

It seems like we have not heard other side's (Mr. Basnyat) statement yet. Based on the information on the site posted earlier (
http://www.ice.gov/pi/news/newsreleases/articles/060314chicago2.htm), which says "Jangam's deportation is part of Operation Predator, an ongoing ICE enforcement initiative to protect children from pornographers, child prostitution rings, Internet predators, alien smugglers, human traffickers, and other predatory criminals. Since this initiative began in July 2003, ICE agents have arrested more than 6,900 individuals nationwide, including more than 340 in Illinois.ICE has intensified its effort hunting hunting nonimmigrants"
I wonder if Mr. Basnyat also became a one of ICS's deleberate hunt. It is interesting to find that from the same university, there were other two international students arrested before (Mexican and Indian). Is it just a coincidence or something else...?

I guess this dude will do a time of about 5 years in medium to light security prison in the event of his conviction.

This is indeed a schocking news! More so because the perpetrator is a fellow Nepali. My sympathies lie with the family who must live with this slander in an already conservative culture like ours. May God give them strength to forbear this tragedy.

While it is premature to give any kind of judgment, positive or negative, relying on the evidence we have, one thing is clear -- Mr. Basnet had some sort of perverse inclinations. Someone posted here that the idea of "underage" or "pedophilia" is not a part of Nepalese vernacular, and I completely agree with you. With a lack of such a clinical label, "crimes" toward "underage" girls especially are perpetrated almost daily in Nepal. Take child marriage for example. I am sure there are places and communities in Nepal where girls below 18 are still getting married off to much older men who, on the pretext of "marriage," commit child rape on a daily basis.

Some people here seem to vindicate Mr. Basnet on the grounds that he didn't actually commit the crime. True. But he had strong intentions to do that, if we are to believe the media. Though he didn't commit the act of pedophilia, he had pedophiliac intentions. Knowing the girl to be 15 yrs old should've been the red signal for the usual internet sex seeker, but her age didn't stop him from sending explicit materials to her which further show his pedophiliac tendencies. It can be strongly inferred that he might have followed up on his intentions, time and place permitting. Someone here also said that the undercover cop might have drawn him in with explicit talks. That is plain rubbish. Why would a so-called Normal person be titilated by a 15 year old in the first place? That would be a pressing cause for concern, were this person to undergo psychological evaluation.

Personally, I am extremely averse to pedophilia and regardless of his nationality, Mr. Basnet's intentions to violate a minor is what provoked me more than whether or not he followed up with actual action. And thank God he didn't get a chance to carry out his plans!

But again, my reactions are based on facts that are currently on the table. Who knows if Mr. Basnet is innocent?

I wonder how many people are intent on cover up of this event and none have spoken for the concern of any underage child who might been preyed if the person on the other side of the internet taking to this dude were actually an underage kid.

Of course such type of offenders are delibrate targets for any law inforcement agencies anywhere around the world. If these creeps dont become delibrate targets how the hell do you think anyone will be able to get rid of these creeps.

Do you think these creeps will just show up infornt of police car to surrender themselves without being delibrately hunted down by the law enforcement agencies ?

I donn't know what the guy in the pic did. But if he was soliciting a minor then YES ! You are talking as if Jeff Skilling of Eron deserves better treatment than a Bambino who is a loan shark ? Just because he went to school, and this was his first offence ...you mean to say that he deserves better treatment than Maaak or Chaaalie from the neighbourhood collecting protection money ? After the court looks at the case he will be prosecuted according to that particular State's judicial system. I mean that is for them to decide. Not me or you. But I feeling is HE SHOULD BE PUNISHED FOR HIS CRIMES. thats all !

Your analogy of ENRON executive and Mr. Basnet is not valid as Mr. Basnet has not committed a crime, yet. Was he in the process...the evidence at hand seems to suggest so. Is there an objective answer to whether he would have performed as he said...NO.

Should he be punished... based on the evidence we have, I would say yes. Should be put behind the bars for 15 years or whatever such conviction warrants, I dont know... An apt punishment for him might [sic] (as I am not sure) a probation of some sort. Given his education background and his stature in a society, his life will never be the same again. May be that is his punishment.

Punishment, I believe, is not for vendatta. Rather it should be designed to suit the victim and the crime. Thats my belief.

Your writing was swell all around. You do bring about an interesting point by saying that the cops couldnt have in any way encouraged Mr. Basnet's intentions: "Why would a so-called Normal person be titilated by a 15 year old in the first place?"
You do give a possible explanation challenging the mental condition of Mr. Basnet. One could also reason by saying if the "girl" hadn't gone out of her way to lure him, may be this would've never happenned. The fact is theres no objective answer in any side. Thats the uniqueness of this case.

I was not comparing Mr Basneyat to Enron Exec. But I was comparing your regular neighbourhood thug to an exec. thug. I mean a thug is a thug regardless of whether its an exec thug or a street thug. SOLICITING A MINOR ONLINE IS A CRIME, THAT WHY IS ASS IS IN JAIL(he was not just on the process of comiting, given time who knows ..he just might have acted upon it. By then it will be too late for law enforcement to prevent it right ?). Some of the guys keep talking as if he had not done anything here(like there was no sex act commited). BUT SOLICITING A MINOR FOR SEX EVEN IF ITS JUST TALKING ABOUT IT IS ALREADY A CRIME HERE. Thats why he is in jail.

ONCE AGAIN HIS SOCIAL STATUS OR HIS EDUCATION IS STILL IRREVALENT TO THE CRIME.

i am not well versed with laws.

1) mr. basnyat did have intentions -YES!

2) he's gonna have sex with a minor - MAY BE/MAY BE NOT!

3) 'evil' intentions are parts of human beings. for instance, sometimes we MAY feel like killing a person 'literally'-YES!

4) Sane minded/sensible/educated can keep their evil intentions under check - Most definitely YES!. Is there a guarantee? -NO!

Question is: can anyone be convicted/punished based upon what he/she 'MAY' be up to? Within a split of a second, a thoroughly depressed person MAY go for or give up the idea of commiting a suicide. innit? Can he/she be tagged a 'coward'?

Iraq was attacked and bush's rationale was: Saddam Hussain was a 'potential threat' to the rest of the world. it may be sensible to take precautions before care done after the damage, but what is the MEASURE to justify the potential of a harm that a peson may hold?

If he had no intentions why the hell was he talking to the person knowing she was sa minor or was he assuming that it is like in back home where such deplorable act go unpunished. I do not feel any sympathy for him but i do feel sorry for his wife and kid. What is ANA doing for them or their aim is to gather every year for parties and photos only? Why not start a fund so taht everyone pitches in and he can afford a lawyer at least for the sake of his wife and kid (he be damned)
