Can someone please tell me when is a good time to apply I-130 (family based green card petition)? I just did and it was rejected on the ground that the visa number is not available for this category forthe present time. The Point is they are NOT even accepting application at present. So my question is when do I apply again so that my application is not rejected and I get a receipt number? PLEASE Help!!!!!!

I recently applied I130 and i got receipt.I applied in Jan,2007 but the way i see in the priority date it is like 2 years down still. So, i am thinking of going through employer GC.So, just quick suggestion to you too to go through employer than family.Just my personnel thoughts.

Thanks Pakandi but my family member is on F-1. I am really wanting to know when would UCIS start accepting I-130 application.

yes I130 is taking for ever. Once it is approved you just have to file Adjustment of Status (485) if you are already in USA. If you are in Nepal you will apply for immigrant visa in the embassy based on approved 130. You don't need to file 140 for family-based petition.

These days INS is not approving 130 unless visa number become available meaning that you will be able to file for 485 or immigrant visa immidiately once 130 is approved.

Earlier they would approve 130 and make you wait until the visa number available. It is no longer situation now.
