I have a question regarding following comment in USCIS document " Current H-1B Workers: Petitions filed on behalf of current H-1B workers do not count towards the congressionally mandated H-1B cap. Accordingly, USCIS will continue to process petitions filed to: • Extend the amount of time a current H-1B worker may remain in the United States. • Change the terms of employment for current H-1B workers. • Allow current H-1B workers to change employers. • Allow current H-1B workers to work concurrently in a second H-1B position. USCIS also notes that, in addition to the cap exemption for aliens with U.S. earned master’s degrees discussed above, certain H-1B petitions are exempt from the cap. Those petitions are not affected by this release." My question: Does that applies to H1B holders from University and National labs also? Before I heard that H1B from universities cannot be transferred to the H1B from industries without going through the cap. Please inform if somebody know about it. Thanks

chrisna, you can not transfer your H1B from non profit organization to profit organizations. that means, if you are working in university or lab and now wants to transfer to some companies, you have to fall on quota system. The H1b you have is from exempted from this quota.

Number! Thanks for the information. If you are true.......I am almost drowned........damn. So literally I cannot start work till Oct 2008, if I can file soon enough to fall in April 1 2008 deadline! Somebody gave a good suggestion above, lets do petition to Datlelin, Cris hansen may investigate the indian asse$.

Birkhe, because that is the rule. one can file H1B petition 6 months before it applies. so, one can apply starting from april 1st but can use it only starting from october 1st.

Because whatever gets approved in April-Jun-Jul ... - October 2007 is federal fiscal year 2008 which starts from Oct 1 2007. You can work if you are currently authorized (CPT,OPT ect) to work which is valid through Oct 1st. otherwise, its not only that you cannot work, either you maintain your status by 1. extending it (if allowed), 2. changing to other status than currnet 3. or by leaving the courntry temporarily. H1B approved from April-October 2007 is valid only from 1st october 2007 (both for status and to apply visa to enter the US)

I just wonder how many of those 150 K were graduates from the US. Instead of the random lottery they should give priority to students who have graduated from an american college or university.
