Hi guys, 
 
I'm new to sajha. I need your serious suggestion.I hope that you dear friends, bros, sis will have sometime for me to overcome this situation. Here is me problem.

I have living here in Northern Virginia for 4 yrs and 10 months and i'm about to get citizenship.Three months ago I got married. It was kind of coincident I like the girl who is Under 18 and it was arranged marriage.  I'm not lying, I didn't know she is under 18. say whatever you friends, bros sis would like to call me but give me good suggestion please.  Will I be able to bring here in State before she turns 18? She is now just 16 and 10 months. Is it  Good Idea to file I-130 right now or wait till she turns 18? I couldn't find any answer in USCIS website.  I heard that I can file petition, I-130 since she is not amerian neither she lives here in State. But couldn't find any solid proof to file right now.

I don't think you can get a marriage certificate since your wife doesn't meet the legal age requirement (in Nepal) to get married in Nepal. And if you want to file I-130 to apply for her immigrant visa on the marriage ground, you need to submit your marriage certificate to USCIS as a valid document of your marriage. You should have at least known her age before getting married with her. By law, I think its illegal to marry a girl under 18 who are still defined as child in Nepal. Good luck

 redo everything, make her new citizenship , correct her age on certificates etc. this is the most easy i think can be done,

Sajha is a terrible place to get a legal advice. Consult an attorney, they charge upto a couple of hundred bucks...some are cheaper or even free. Otherwise post it on a legal forum where you pay an attorney for answer.
As far as I know, most states (except NE and MS) require 18 yrs. but if you have parental or judicial consent you possibly can get married.
Again, ask an attorney, this is an important decision and you should've known better than blindly marrying an underage...sorry for judging.

I second Kiddo. You don't need to be 18 as long as you have parental consent. But better get an attorney.

 That's what I heard. In the case of Arranged marriage (i.e. parental consent) 16yr is minimum age to get married in Nepal.
Check with an attorney.

You can't marry someone younger than 18. Parental consent is for couples that are both less than 18.
Sorry to judge but how can someone marry a 16 year old? And not know she is 16. Was she studying in 10th grade? It is hard not to be judgmental in these cases but it is pretty pathetic for someone to go to Nepal and as an adult marry a 16 year old.

What did I say, Sajha is not the best place for legal advice. People give advices w/o knowing much on the issue and having no concern about the effects.

The last post states both bride and groom need to be under 18, completely trashing every suggestion given above. Now would you trust that suggestion? I wouldn't. And I wouldn't also trust my suggestion since I am not a legal expert nor a lawyer. Bit if it helps read this and note the word "If either of you is/are under 18," meaning both DON'T need to be under 18:

 Consulting an attorney would be the best bet, especially for rare cases like this.
